Privacy Policy
Effective Date: June 22, 2007
This Privacy Policy (“Privacy Policy”) designed to explain how SportsMD Media Inc. (hereafter, individually and collectively, “we”, “us” or “GMD”): (i) collects, uses and shares information, (ii) with whom the information may be shared; (iii) what choices are available to you regarding our collection, use, and sharing of the information; (iv) how you can correct inaccuracies in the information; (v) the kind of security procedures in place to protect personal information that is under our control; and (vi) covers all products, Content, features, specifications, software, services, communications, and Public Areas which you may have access to as part of, or through your use of, the GolfersMD’s web site(s) (including our online store) (referred to individually and collectively starting with the word “products” as the “Service(s)”).

This Privacy Policy does not apply to the practices of companies that GMD does not own or control, or to people that GMD does not employ or manage.

Where more detailed information is needed to explain our privacy practices, we may post separate privacy notices to describe how particular services collect, use and share information; such privacy notices are incorporated herein by this reference. We hope this will help you make an informed decision about sharing information with us.

By accessing or using the Services, you agree to this Privacy Policy. This is our entire and exclusive privacy policy and it supersedes any earlier version(s). This Privacy Policy is part of our Terms of Service.  Except as otherwise provided in this Privacy Policy, all capitalized terms defined in said Terms of Service shall have the meanings ascribed to such terms therein.

Information Collection and Use
We collect personal and non-personal information to customize the content and advertising you see, fulfill your requests for products or services, improve our services, and for purposes of contacting you. We will also use your information to pre-fill fields to save you from entering the same information over and over again. By knowing about you, we can deliver more helpful information, programs and tools, and offer you the most relevant services.

There are many aspects of our Services that can be enjoyed as a visitor, but you need to register in order to take advantage of certain Services.

Information You Provide
You may be asked to provide personal information in certain fields on the Services. •    Golf handicap
•    Personal interests
•    Date of birth
•    Customer service information
•    Transaction-related information, including, credit card or other preferred means of payment, billing or shipping information, or a history of products or services purchased
•    Any other information needed to provide you with a service that you have requested
Examples of scenarios where our visitors and subscribers provide their personal information include, but may not be limited, to:
•    Emailing, calling, accessing, using or communicating with GMD or the Services
•    Posting a question or comment through the Services
•    Requesting literature or Content
•    Registering
•    Transactions
•    Customer service
•    Participating in an online survey
•    Requesting inclusion in an email or other mailing list
•    Invitations
•    Submitting an entry for a contest or other promotions
•    Logging in to the Services, thus requiring a user name and/or a password

GMD will allow you to either agree or decline to give your personal information via the Internet. GMD will inform you of the purpose for the collection and GMD does not intend to transfer your personal information to third parties without your consent, except under the limited conditions described below. If you choose to provide us with your personal information, GMD may communicate with you at the contact information you have provided and we may transfer that information, within GMD or to a third party service provider as necessary.
Domain Information Collection
GMD may collect domain information to enable us to analyze how our visitors use our Services. This data enables us to become more familiar with which people visit our Services, how often they visit, and what parts of the Services they visit most often. GMD uses this information to improve its Web-based offerings. This information is collected automatically and requires no action on your part.  Our Web advertising partners may use your IP address to determine your approximate geographic location in order to provide you with location-relevant advertising.

Special Note for Parents
The Services are a general audience Services and not designed or intended to attract children younger than 13. We do not collect personal information from any person we actually know is younger than 13, without parental or such person’s legal guardian’s consent.  Provided that, such parent or guardian is solely responsible for providing supervision of the minor's use of the Services. The parent or guardian assumes full responsibility for ensuring that the minor’s information is kept secure and that the information submitted is accurate. The parent or guardian also assumes full responsibility for the interpretation and use of any information or suggestions provided through the Services for the minor.

Use of Cookies and Tracking User Traffic

Some pages on the Services may use “cookies”—small files that the Services place on your hard drive for identification purposes. A cookie file can contain information such as a user ID to track the pages visited, but the only personal information a cookie can contain is information you supply yourself. These files are used for Services registration and customization the next time you visit us.
Some parts of the Services may also use cookies to track user traffic patterns. GMD does this in order to determine the usefulness of our Services information to our users and to see how effective our navigational structure is in helping users reach that information. Please note that cookies cannot read data off of your hard drive. Your Web browser may allow you to be notified when you are receiving a cookie, giving you the choice to accept it or not. If you prefer not to receive cookies while browsing our Services, you can set your browser to warn you before accepting cookies and refuse the cookie when your browser alerts you to its presence. You can also refuse all cookies by turning them off in your browser, by not accepting cookies, some pages may not fully function and you may not be able to access certain information on the Services.

Our Web advertising partners may place or recognize a unique cookie on your browser in order to control the sequence of advertisements you see and to make sure you do not see the same ad too many times. To turn off Web advertising partners cookies, please visit the web advertiser’s Web site. If you opt out of cookies, you will still see advertisements on our Services. These ads will be targeted only on the basis of the non-personal information that is automatically transmitted on the Internet, such as information collected in our Web logs and the approximate geographic location of your computer.

We also have agreements with companies, sometimes called “Ad Networks,” that serve advertising on behalf of third parties. These Ad Networks may place or recognize a unique cookie, sometimes called a “third party cookie,” on your browser. Ad Networks use cookies to understand Web usage patterns of people who see advertisements, to control the sequence of advertisements you see, to provide you with the most relevant advertising, and to control the number of times you see a particular advertisement. Ad Networks may connect information about pages you visited on our Services with information about pages you visit on other Web sites and show you advertising based on this combined information.

Web Beacons
We and our advertisers also use Web beacons, sometimes called single-pixel GIFs, that momentarily direct your browser to a server other than GMD in a way that may not be apparent to you. Web beacons are used to count users who visited specific pages and determine which emails were opened and/or acted upon when we send HTML-formatted email messages. We do not link any identifying information to Web beacons.

Information That We Obtain From Third Parties
We will use third party information, combined with information you provide to us and information collected by our systems, to better understand the characteristics of the visitors to and uses of our Services and to develop new products, services and content areas. This information will also allow us to tailor content, advertising and offers to your specific interests and needs.

When we associate information that we obtain from third parties with personal information that we have collected under this policy, we will treat the acquired information like the information that we collected ourselves. We will not share information we obtain from third parties in personally identifiable form, except under the limited conditions described herein. However, we may share aggregated, non-personal information as described in this Privacy Policy. This may include information we obtain from third parties in a form that does not permit you to be identified. We may obtain and use this kind of information from third parties without receiving further permission from you to do so.

Information Disclosure to Third Parties
We know how important it is to keep the information you have entrusted to us confidential. We will not share personal information about you with third parties except to provide you with a product or service you request or under certain circumstances as described herein. In all other cases, we will ask for your permission before we disclose your personal information.

Disclosure for Legal Reasons
GMD will disclose your personal information or any other information collected or provided if required to do so by law, or in urgent circumstances, to protect personal safety, the public or our Services.

Agents and Contractors
By using the Services you are consenting to share your personal information and non-personal information to a third party service provider working on our behalf to serve you or to provide a service to us, such as operating, updating, enhancing and/or providing the Services.  If such third parties have access to non public personally identifiable information, they are required to protect this information in a manner that is consistent with this Privacy Policy or any applicable service-specific privacy notice or restricted from using or disclosing such non public personally identifiable information for any purpose other than to carry out the services they are performing for the us.

Aggregated, Non-Personal Information
We may share aggregated information about you with third parties. This is information that is combined with the non-personal information of other users and does not allow you to be identified or contacted. Depending on the circumstances, we may or may not charge third parties for this aggregated information. We also may not limit the third parties’ use of the aggregated information.

Contests and Sweepstakes
GMD will offer or co-sponsor sweepstakes and contests. Any information submitted by the user for purposes of participation in these promotions, may be shared publicly and with any affiliates of the promotion. This information may be necessary for contacting you with regard to status of the promotion or prizes awarded. All contests and sweepstakes will specifically inform the participants whether their information will be shared.  

Changes in Our Corporate Structure
If all or part of our company is sold, merged or otherwise transferred to another entity, the personal information you have provided to or that we gathered from your access to, interaction with or use of the Services and any other information (including proprietary and confidential information) may be transferred as part of that transaction. We will take steps to ensure that, without your consent, any personal information that is transferred will not be used or shared in a manner inconsistent with the Privacy Policy under which it was collected.

Community Areas
The Services feature community areas such as message boards, blogs, chat rooms and other public forums where people with similar interests can share information or where users can post questions for experts to answer, which includes, online discussions moderated by medical, healthcare and sport experts (all of the foregoing, individually and collectively “Public Areas”). Please remember that any information that you post in Public Areas is, by design, open to the public and is not a private, secure service.  You should think carefully before disclosing any personally identifiable or personal health information in any Public Areas. What you have written and or posted may be seen, disclosed to or collected by third parties and may be used by others in ways we are unable to control or predict, including to contact you for unauthorized purposes. As with any public forum on any Web site, this information may also appear in third-party search engines like Google, Yahoo, MSN etc.

Co-Branding
Some products or services may be co-branded and offered in conjunction with another company. If you register for or use such products or services, both GMD and the other company may receive the information collected in conjunction with the co-branded product or services. Please refer to that company's privacy policy to determine how that company may use this Information.
Links to Third Party Web Sites

The Services may contain links to other Web sites. GMD does not share your personal information with those Web sites, except as set forth herein, and is not responsible for their privacy practices. We encourage you to learn about the privacy policies of those Web sites. This Privacy Policy applies solely to information collected by or provided to GMD.

Confidentiality and Security  
GMD has implemented reasonable security measures in order to protect both personal and non-personal information from loss, misuse and unauthorized access, disclosure, alteration or destruction. Secure Shopping
When you place orders on our Services, all of your order information, including your card number and delivery address, is transmitted through the Internet using Secure Sockets Layer (“SSL”) technology. SSL technology causes your browser to encrypt your order information before transmitting it. SSL technology, an industry standard, is designed to prevent someone other than operators of our Services from capturing and viewing your personal information. Since any order information you provide to us on our Services will be transmitted using a secure connection, if your Web browser cannot support this level of security, you will not be able to order products through our Services. The most recent versions of Netscape Navigator™ and Microsoft Internet Explorer® can support a secure connection and can be downloaded for free from the Netscape and Microsoft web site respectively.

Notice to All Members
If you are unsure whether this privacy policy is in conflict with the applicable local rules where you are located, you should not submit your personal information to the Services. Visitors, users, subscribers, members and anyone else who accesses, uses or interacts with the Services who submits personal information do thereby consent to: (i) the international transfer and/or storage of such information to a country which may be deemed to have inadequate data protection and (ii) the collection, using and sharing of such information as provided in this Privacy Policy.
Changes to this Privacy Policy

This policy is effective  June 22, 2007. GMD reserves the right to change, modify or update this Privacy Policy at any time without notice and for any reason. Any substantial changes in the way we use your personal information may be posted on the Services in our sole discretion. Your access, use or interaction with the Services following the posting of such changes or the updated Privacy Policy will constitute your acceptance of any such changes. We encourage you to review our Privacy Policy frequently to make sure that you understand how we collect, tracks, compiles, use and share information.
